Terms & Conditions

1. General

These Terms and Conditions ("Terms") govern the use of services provided by Boris Boats, obrt za usluge, trading as Boka Boats ("we", "us", "our"), a boat rental and tour operator based in Hvar, Croatia.

By making a booking through our website (boatrenthvar.com), email, WhatsApp, or in person, you ("the Guest") agree to these Terms.

2. Booking & confirmation

• A booking is confirmed once you receive an automatic confirmation email with your booking reference number.
• For bookings requiring online payment, the reservation is confirmed only after successful payment.
• For enquiry-based bookings, we will confirm availability manually and send you a confirmation within a few hours.
• All information provided during booking (name, email, group size, dates) must be accurate. You are responsible for any errors.

3. Prices & payment

• All prices are listed in Euros (EUR) and include VAT where applicable.
• Fuel is not included in the rental price unless explicitly stated.
• A confirmation payment of 30% of the total amount is required to secure your booking. The remaining 70% is due on the day of departure, payable in cash or by card.
• Online payments are processed securely via Stripe (credit/debit cards, Apple Pay, Google Pay) or PayPal. You may also pay the remaining balance in cash upon arrival.
• We reserve the right to update prices at any time. The price confirmed at the time of booking is the price you pay.

4. Cancellation & refund policy

Cancellation by the Guest

All cancellations must be communicated in writing (email or WhatsApp). The date we receive your cancellation message determines which policy applies.

Cancellation by Boka Boats

• If we cancel due to weather conditions, mechanical issues, or other circumstances beyond our control, you will receive a full refund or the option to reschedule at no extra cost.
• Weather-related cancellations are made at the discretion of the skipper or our team based on safety conditions. Wind speed, wave height, and official maritime warnings are taken into account.

5. Boat rental — self-drive

• A valid boat licence is required for all boats, in accordance with Croatian maritime law. You must present your licence before departure.
• You must be at least 18 years old to rent a boat.
• The boat must be returned at the agreed time and in the same condition it was received. Late returns may incur additional charges.
• The Guest is responsible for any damage caused during the rental period due to negligence or misuse. No security deposit is required, but the Guest accepts full liability for damage resulting from reckless use or violation of maritime rules.
• Boats must not be used for racing, towing, or any commercial activity.
• Navigating under the influence of alcohol or drugs is strictly prohibited and illegal under Croatian law.

6. Tours & skippered charters

• Tour itineraries are indicative and may be adjusted by the skipper due to weather, sea conditions, or safety concerns.
• Our skipper has full authority over navigation, route, and safety decisions during the trip.
• Guests must follow the skipper's instructions at all times, particularly regarding safety.
• Tours include fuel, skipper, and equipment as described on our website. Food, drinks, and entrance fees (e.g., Blue Cave) are not included unless stated.

7. Transfers

• Transfer times are approximate. We make every effort to be punctual but cannot guarantee exact arrival times due to sea and weather conditions.
• Guests are responsible for being at the pick-up point on time. Delays caused by the Guest may result in reduced service or forfeiture of the transfer.

8. Safety & liability

• All boats are equipped with required safety equipment (life jackets, first aid kit, fire extinguisher, etc.) as mandated by Croatian maritime regulations.
• Guests must wear life jackets when instructed and follow all safety briefings.
• Boris Boats, obrt za usluge (trading as Boka Boats) holds valid liability insurance as required by Croatian law.
• We are not liable for personal injury, loss of belongings, or any indirect damages arising from the Guest's own negligence, violation of these Terms, or Force Majeure events.
• Swimming, diving, and water activities are undertaken at the Guest's own risk.

9. Weather & Force Majeure

We reserve the right to cancel or modify any service due to adverse weather conditions, natural disasters, government restrictions, or other events beyond our reasonable control ("Force Majeure"). In such cases, Section 4 (Cancellation by Boka Boats) applies.

10. Guest conduct

• Guests are expected to behave responsibly and respectfully towards our staff, equipment, and the marine environment.
• Littering at sea is strictly prohibited. All waste must be brought back to shore.
• We reserve the right to refuse service or terminate a trip if a Guest's behaviour endangers safety or violates these Terms. No refund will be provided in such cases.

11. Intellectual property

All content on boatrenthvar.com — including text, images, logos, and design — is the property of Boris Boats, obrt za usluge (Boka Boats) and is protected by copyright. Reproduction without written permission is prohibited.

12. Privacy

Your personal data is handled in accordance with our Privacy Policy. By booking with us, you acknowledge that you have read and understood how we process your data.

13. Governing law & disputes

These Terms are governed by the laws of the Republic of Croatia. Any disputes arising from these Terms shall be resolved by the competent court in Split, Croatia.

14. Changes to these Terms

We may update these Terms from time to time. The current version is always available on this page. Continued use of our services after changes constitutes acceptance of the updated Terms.
